The Fair Labor Standards Act requires that all non-exempt employees who work more than 40 hours in the workweek be paid at least one and one-half times their regular rate of pay for the overtime hours worked.   • The duration of the working relationship
  • The extent to which the work is an integral part of the employer’s business.

An employer may also attempt to deny overtime compensation by claiming an employee falls under an exemption from overtime under an administrative, executive, or professional exemption; or as a computer professional or commissioned salesperson.
